Deferred Prosecution

A deferred prosecution is an agreement between the defendant, his lawyer, and the prosecutor to dismiss a case provided that certain requirements be fulfilled. A deferred prosecution agreement (DFA) occurs when the prosecutor is willing to grant amnesty as long as the accused will comply with the stated demands. For instance, the prosecution agrees to drop the charges when the defendant fully cooperates with the investigation. However, the case may be refiled if the defendant does not observe the requirements.
